Productily LLC ("Productily," "we," "our," or "us") is committed to protecting the privacy and personal information of every individual who uses our platform, website, mobile application, and related services (collectively, the "Services"). This Privacy Policy explains how we collect, use, store, and safeguard your information.

Our core commitment: We do not sell, rent, trade, license, or otherwise share your personal data with any third parties. Your data is used exclusively by Productily LLC for the sole purpose of providing and improving our Services to you. Period.

This Privacy Policy is governed by the laws of the State of New Jersey, United States.


1. Information We Collect

We collect only the information necessary to deliver our Services and provide you with the best possible experience. We collect information in the following categories:

1.1 Information You Provide Directly

• Account registration information (name, email address, password)
• Profile information you choose to add (preferences, time zone, household details)
• Payment and billing information (processed securely; see Section 5)
• Content you create, input, or upload within the app (tasks, schedules, lists, notes, preferences)
• Communications you send to us (support requests, feedback, survey responses)

1.2 Information Collected Automatically

• Device information (device type, operating system, browser type, unique device identifiers)
• Usage data (features accessed, frequency of use, interaction patterns, session duration)
• Log data (IP address, access times, pages viewed, app crashes or errors)
• Cookies and similar technologies (see Section 8 for details)

1.3 Information from Phoebe (AI Assistant)

Our AI assistant, Phoebe, processes your inputs and activity within the app to provide personalized automation, recommendations, and task management. All data processed by Phoebe remains within the Productily platform and is never shared externally.


2. How We Use Your Information

All data we collect is used exclusively by Productily LLC for internal purposes. We use your information solely for the following purposes:

• To provide, operate, and maintain our Services
• To personalize your experience and deliver relevant content and recommendations through Phoebe
• To automate life administration tasks across your selected service areas (finances, scheduling, shopping, household management, wellness, social coordination, and others)
• To process transactions and manage your subscription
• To communicate with you regarding your account, updates, security alerts, and support
• To analyze usage trends and improve our platform, features, and user experience
• To detect, prevent, and address fraud, abuse, security incidents, and technical issues
• To comply with legal obligations and enforce our terms of service

We will never use your data for purposes beyond those described in this policy without obtaining your explicit consent first.


3. What We Do NOT Do With Your Data

This section is the heart of our privacy commitment. Productily LLC makes the following unequivocal guarantees:

✘ We do NOT rent, lease, or license your data to anyone.
✘ We do NOT share your data with advertisers or ad networks.
✘ We do NOT share your data with data brokers or analytics companies.
✘ We do NOT share your data with marketing platforms.
✘ We do NOT trade your data for any form of compensation.
✘ We do NOT allow third parties to access, collect, or mine your data through our platform.
✘ We do NOT use your data to build profiles for external entities.

Your data exists for one reason: to serve you within the Productily platform. It never leaves our ecosystem for commercial purposes.


4. Data Storage and Security

We take the security of your personal information seriously and implement industry-standard measures to protect it.

4.1 Storage

• All personal data is stored on secure, encrypted servers located in the United States.
• Data is encrypted at rest using AES-256 encryption and in transit using TLS 1.2 or higher.
• We maintain strict access controls, ensuring only authorized Productily personnel can access user data, and only when necessary for the operation of our Services.

4.2 Security Measures

• SOC 2 compliant infrastructure and operational controls
• Multi-factor authentication for internal system access
• Regular security audits and vulnerability assessments
• Intrusion detection and monitoring systems
• Employee security training and confidentiality agreements
• Incident response procedures with prompt user notification in the event of a breach

Productily maintains SOC 2 (Service Organization Control 2) compliance, which means our systems and processes are independently audited to ensure they meet rigorous standards for security, availability, processing integrity, confidentiality, and privacy.

4.3 Data Retention

We retain your personal data only for as long as is necessary to provide our Services or as required by law. Upon account deletion, we will permanently delete or anonymize your data within thirty (30) days, except where retention is required by applicable law or regulation.


5. Payment Information

When you subscribe to Productily, payment processing is handled through a PCI-DSS compliant payment processor. Productily does not directly store your full credit card number, CVV, or banking details on our servers. We retain only the minimum transactional records necessary for billing management (such as the last four digits of your card, transaction IDs, and billing dates).

Important: Our payment processor operates under strict contractual obligations and processes data only as directed by Productily for the sole purpose of completing your transactions. They are prohibited from using your payment data for any other purpose.


6. Your Rights and Choices

We believe you should have full control over your personal information. Regardless of your location, Productily provides the following rights to all users:

6.1 Access and Portability

You have the right to request a copy of all personal data we hold about you, delivered in a commonly used, machine-readable format.

6.2 Correction

You may request that we correct any inaccurate or incomplete personal data.

6.3 Deletion

You may request the complete deletion of your account and all associated personal data. We will process deletion requests within thirty (30) days.

6.4 Restriction and Objection

You may request that we restrict or stop certain processing of your personal data.

6.5 Withdrawal of Consent

Where processing is based on consent, you may withdraw that consent at any time. Withdrawal does not affect the lawfulness of processing conducted prior to withdrawal.

6.6 How to Exercise Your Rights

To exercise any of these rights, please contact us at support@productilyapp.com. We will respond to verified requests within thirty (30) days. We will never charge a fee for exercising your privacy rights.


7. Children's Privacy

Productily is not directed at individuals under the age of 18. We do not knowingly collect personal information from children. If we become aware that we have inadvertently collected data from a child under 18, we will promptly delete that information. If you believe a child has provided us with personal data, please contact us immediately at support@productilyapp.com.


8. Cookies and Tracking Technologies

We use only essential cookies and similar technologies necessary for the proper functioning of our Services. Specifically:

• Essential/Functional Cookies: Required for authentication, session management, security, and core functionality. These cannot be disabled while using our Services.

• Analytics (Internal Only): We may use first-party analytics to understand how users interact with our platform. This data is collected and analyzed internally by Productily only. We do not use third-party analytics services that track you across other websites or apps.

We do not use: advertising cookies, tracking pixels from third-party ad networks, social media tracking widgets, or any technology that enables third-party behavioral profiling of our users.


9. Do Not Track Signals

Productily honors Do Not Track ("DNT") signals transmitted by your browser. Because we do not engage in cross-site tracking or share data with third parties for advertising purposes, our practices are consistent with DNT principles by default.


10. State-Specific Privacy Rights

10.1 California Residents (CCPA/CPRA)

If you are a California resident, you have additional rights under the California Consumer Privacy Act (CCPA) and California Privacy Rights Act (CPRA), including the right to know what personal information we collect, the right to delete it, and the right to opt out of the sale of personal information.

Because Productily does not sell, share, or disclose personal information to third parties for any commercial purpose, the right to opt out of the "sale" or "sharing" of data is satisfied by our existing practices. We do not engage in activities that would require an opt-out mechanism under CCPA/CPRA.

We do not use sensitive personal information for purposes beyond what is necessary to provide our Services.

10.2 Virginia, Colorado, Connecticut, Utah, and Other State Privacy Laws

If you reside in a state with consumer privacy legislation (such as the Virginia CDPA, Colorado CPA, Connecticut CTDPA, or similar laws), you may have rights to access, correct, delete, and obtain a copy of your data, as well as the right to opt out of targeted advertising, profiling, and the sale of personal data. Productily's practices already satisfy these requirements because we do not engage in any of these activities.

10.3 New Jersey Residents

As a company governed by New Jersey law, Productily complies with all applicable New Jersey data protection requirements. New Jersey residents may contact us at any time to exercise their data rights.


11. International Users

If you access our Services from outside the United States, please be aware that your data is transferred to and stored in the United States. By using our Services, you consent to this transfer. We ensure that all data is treated with the same level of protection described in this policy, regardless of your location.

For users in the European Economic Area (EEA), United Kingdom, or other jurisdictions with comprehensive data protection laws, we process your data on the legal bases of contractual necessity (to provide the Services you requested) and legitimate interest (to improve and secure our platform), and we provide you with all rights afforded under applicable data protection laws, including the GDPR.


12. Strictly Limited Service Providers

To operate our Services, Productily may engage a limited number of service providers (such as cloud hosting and payment processing) who require access to certain data solely to perform services on our behalf. These relationships are governed by the following strict requirements:

• Service providers are contractually prohibited from using your data for any purpose other than performing services for Productily.
• Service providers may not sell, share, retain, or disclose your data to any other party.
• Service providers are required to maintain security standards equal to or greater than our own.
• We conduct due diligence on all service providers before engagement.
• Service providers have access only to the minimum data necessary to perform their specific function.

To be clear: These service providers act as data processors under our direct control and instruction. They are not "third parties" receiving your data for their own purposes. Your data remains within the Productily ecosystem at all times.


13. Legal Disclosures

Productily may disclose personal data only in the following narrowly defined circumstances:

• Legal Requirement: When required to comply with a valid subpoena, court order, or other binding legal process.
• Safety: When necessary to protect the safety, rights, or property of Productily, our users, or the public.
• Fraud Prevention: When necessary to detect, prevent, or address fraud, security incidents, or technical issues.

In any such event, we will disclose only the minimum information required and will notify affected users to the extent permitted by law. We will challenge overbroad or improper requests.


14. Business Transfers

In the event of a merger, acquisition, reorganization, bankruptcy, or sale of all or a portion of our assets, your personal data may be transferred as part of that transaction. In such an event, we will notify you and ensure that the acquiring entity is bound by the same privacy commitments described in this policy, or we will provide you the opportunity to delete your data before the transfer.


15. AI and Automated Processing (Phoebe)

Our AI assistant Phoebe uses automated processing to provide you with personalized task automation, recommendations, and life management support. The following applies:

• All AI processing occurs within Productily's internal systems.
• Your data is not used to train external AI models or shared with external AI providers for model improvement.
• Phoebe's recommendations are based solely on your individual data and preferences.
• You may request human review of any automated decision that significantly affects you.
• You may adjust or disable specific AI features at any time through your account settings.


16. Data Breach Notification

In the unlikely event of a data breach that affects your personal information, Productily will:

• Notify affected users within seventy-two (72) hours of confirmed discovery.
• Provide clear information about what data was affected and what steps we are taking.
• Notify relevant regulatory authorities as required by law.
• Offer guidance and support to affected users.


17. Changes to This Privacy Policy

We may update this Privacy Policy from time to time to reflect changes in our practices, technology, or legal requirements. When we make material changes:

• We will notify you via email and/or a prominent notice within the app at least thirty (30) days before the changes take effect.
• We will clearly describe what has changed.
• We will update the "Last Updated" date at the top of this policy.
• For material changes to data sharing practices (should our policy ever evolve), we will obtain your explicit opt-in consent.

Your continued use of our Services after the effective date of any updated policy constitutes acceptance of the changes.
